The Status of Children in the Annulment of Mixed Marriages: Living Fiqh Perspectives, Legal Pluralism, and Maqāṣid al-Sharī'ah

Abstract

The annulment of intermarriage in contemporary Muslim society not only raises cross-border legal issues, but also raises issues regarding the legal status of children. Fiqh's approach that tends to be textual is often not able to provide optimal protection for children's civil rights after the marriage is declared null and void. This study aims to analyze the legal status of children after the annulment of mixed marriage through the paradigm of living fiqh integrated with International Civil Law, national law, and Maqāṣid al-Sharī'ah, especially the principle of ḥifẓ al-nasl. The research uses socio-legal methods with legislative, conceptual, and court decision analysis approaches. The results of the study show that the annulment of marriage due to administrative defects and legal smuggling does not remove the civil status of children. The paradigm of living fiqh places the protection of children's nasab, identity, and rights as a form of benefit that must be prioritized through the harmonization of Islamic law, national law, and the principle of child protection. This study concludes that this approach can be a normative and sociological basis in guaranteeing the rights of identity, nasab, citizenship, and legal protection of children in disputes over the annulment of mixed marriages.
